No tacit extension of Mobistar's 2G licence

Extension until 2013 announced
Brussels, 5th December 2008. - The BIPT (Belgian Institute for Postal Services and Telecommunications) and the Minister Vincent Van Quickenborne, have informed Mobistar that there will be no tacit extension of its 2G licence in the two years leading up to the initially agreed date of 27 November 2010. The Minister and the BIPT have announced its renewal up to July 2013, subject to financial conditions. The conditions governing this renewal have been set out in a draft Royal Decree, which was discussed today by the Council of Ministers and which will be submitted to the Council of State for consideration. According to this text, the amount of financial compensation for this renewal should be calculated on a pro rata basis, based on the initial licence cost and adjusted in line with the consumer price index. This represents an unindexed amount of 103,288.97 Euros per additional month per MHz duplex.


Mobistar has raised a number of objections against this decision, in the light of, inter alia, the principles of good administration, proportionality and non-discrimination, and henceforth reserves the right to bring the relevant legal actions before the competent jurisdictions.
