Mobistar, KPN, BASE Company and Proximus reach a settlement agreement on mobile tariff related litigations

Today, Mobistar, KPN, BASE Company and Proximus have agreed to settle all outstanding litigation between BASE Company, Mobistar and Proximus related to the practice of applying tariffs from the past for mobile telecommunication services that are differentiated between on-net[1] and off-net[2] voice communications.

More specifically, KPN, BASE Company, Mobistar and Proximus agreed to bring to an end a longstanding claim that has been launched by BASE Company and Mobistar in 2003, leading to the interlocutory judgement of the Court of Appeal of Brussels of 26 February 2015, as well as to a series of other connected litigations.

 

This settlement agreement is without any harmful recognition and translates the willingness of the parties to put an end to litigation proceedings initiated more than 10 years ago.

 

The settlement agreement involves payment of an amount of EUR 120 million of which EUR 66 million is paid to BASE Company and EUR 54 million to Mobistar.
